Loan Application Terms & Conditions

These general terms and conditions apply to loan application services provided by AJ Motors Ltd (including the services described below) and other companies trading as “AJ Motors” (each “we”, “us”, “our”). These general terms and conditions, together with your acknowledgements, agreements and confirmation when completing our finance information page, and the Privacy Policy, are the agreement between you and us for our loan application services (the “Agreement”).

Our loan application services help you to access finance for vehicle purchases through our network of reputable lenders. Those services are:

  • Collecting information from you about you and your finance needs.
  • Assessing which lenders we consider are more likely to agree to finance your purchase based on the amount you wish to borrow, your credit history and other personal information.
  • Applying for finance on your behalf.
  • Collecting from you information and documents requested by relevant lenders and passing them to the lenders.

We do not assess whether a loan is suitable for you or affordable. Lenders make the lending decisions based on their credit, suitability and affordability criteria. If you are unable to obtain finance with our assistance within a reasonable time (usually 2-5 working days) of an application, we may not be able to help you further. We might refer you to a broker to assist. We are not responsible for the broker.

  • You appoint us as your agent to apply for vehicle finance on your behalf.
  • You agree and confirm that on any ongoing basis that:
    • We do not guarantee that you will be able to obtain vehicle finance through our services.
    • We are not agents for the lenders and we have no responsibility for their conduct, whether before or after you make a finance application or enter into any agreements with a lender.
    • You will promptly provide us with all information (including updated information) that we reasonably request in connection with the Services.
    • All information you supply to us and lenders is correct, complete and up-to-date.
    • Where there has been any significant change in circumstances when we are assisting you, you will provide us with updated information (even if we do not request that information).
    • We have no obligation to check that information you provide to us or a lender is correct, up- to-date or complete.
  • I/we authorise:
    • AJ Motors to provide me/us with loan application services in accordance with these general terms & conditions.
    • AJ Motors to collect, use, disclose, store and protect personal information about me/us in accordance with the Privacy Policy.
    • AJ Motors to disclose information in my/our finance application and other information about me/us held by AJ Motors to lenders in connection with assessing a finance application from me/us and providing finance to me/us.
    • AJ Motors and lenders to collect information about me/us from employer(s), accountant(s), relatives, credit reporting agencies (“CRA”) and other relevant persons (“Third Parties”) information about me/us in connection with my/our finance application(s).
    • Relevant Third Parties to disclose information about me/us to the AJ Motors and the lenders.
    • AJ Motors and lenders to disclose my/our information to CRAs to carry out credit checks on me/us.
    • Lenders & AJ Motors to contact me about my/our loan applications and approved loans.
    • Credit reporting agencies used by AJ Motors and lenders to hold my/our personal information on their systems and to use it to provide credit reporting services including giving information about my/our defaults to other customers of the CRAs.
  • You do not pay any fees for our services. We receive a commission from the lender if you obtain finance with our assistance. We also obtain commission from insurers if we refer you to relevant insurers and you obtain insurance from any of them. You hereby consent to us receiving such commissions.
  • No provision in the Agreement is intended to have the effect of contracting out of your rights under the Consumer Guarantees Act 1993, except to the extent permitted by law. Where you are in trade you agree that our services are being acquired in trade, to contract out of Consumer Guarantees Act 1993 and that it is fair and reasonable to do so.
  • To the maximum extent permitted by law, our liability to you under and in connection with the Agreement, whether arising in contract, tort (including negligence), equity or otherwise, shall be:
    • be limited to an obligation to resupply our services only; and
    • without limiting that, if we are otherwise liable our liability is limited to direct Losses only, excluding any consequential Loss or loss of profit, income or saving.
  • Each party must take reasonable steps to mitigate (reduce) any Losses that party may suffer or incur arising out of anything done or not done by the other party under or in connection with the Agreement.
  • Our services are provided, and obligations are owed, only to you and do not extend to any other person (including family members, directors &related companies).
  • If you are comprised of more than one person (including more than one individual):
    • your warranties, agreements, obligations and liabilities to us are joint & several; and
    • any one person is authorised to provide any information, documents, consents, authorisations or acknowledgements we require in relation to our services (including in relation to applications), and to enter into any variations to the Agreement, on behalf of all. All other persons shall be bound by the actions of that person. We are not obliged to seek confirmation of such matters from any other person.
  • This Agreement sets out everything agreed between you and us relating to our services described above and applies in place of, and cancels, anything discussed, exchanged or agreed before the start of the Agreement in relation to those services. This Agreement is in addition to, and does not replace or amend, any vehicle offer and sale agreement (or similar agreement) between you and us.
  • You may not assign or transfer any right or obligation under the Agreement.
  • Any variation to the Agreement must be in writing and signed by all parties.
  • Expiry or termination of the Agreement does not affect each party’s rights and obligations that accrued before the date of termination or expiry of the Agreement.
  • In these general terms and conditions a reference to:
    • "you", "your" are to our customer, being the person(s) named in this finance application.
    • "Loss" includes loss, damage, liability, costs and expenses.
    • "including" and similar words do not imply any limitation.
